      What is an O-1 Visa?​

      The O-1 visa is a non-immigrant visa for individuals with extraordinary ability or achievement in their field. It is designed for foreign nationals who have demonstrated sustained national or international acclaim in areas such as sciences, arts, education, business, athletics, or the motion picture/television industry. This visa provides:

      Types of O-1 Visas

      1. O-1A Visa

      • For individuals with extraordinary ability in sciences, education, business, or athletics (excluding the arts, motion pictures, or television).
      • Applicants must demonstrate a high level of expertise and recognition in their field, usually through awards, publications, critical roles, high salaries, or membership in elite organizations.

      2. O-1B Visa

      • For individuals with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry.
      • The applicant must show distinction in the arts or a record of extraordinary achievement in film/TV, which can be proven through awards, critical reviews, or commercial success.

      • O-2 Visa: For support personnel of O-1 visa holders, such as assistants or essential team members who help the O-1 applicant perform in their field.
      • O-3 Visa: For spouses and children of O-1 and O-2 visa holders.

      Some Of The Benefits of an O-1 Visa

      1. Faster Processing and No Backlog

      • O-1 Visa: Processing is much faster (typically a few weeks to a couple of months). Premium processing is available, reducing the wait time to 15 days.
      • EB-1 Green Card: Indians face long backlogs in EB-1 due to per-country visa limits. It can take several years for an EB-1 priority date to become current.

      2. Immediate Work Authorization

      • O-1 Visa: Once approved, you can start working in the U.S. immediately.
      • EB-1 Green Card: Even if the I-140 (Immigrant Petition) is approved, you must wait for a current priority date to file for Adjustment of Status (I-485) and receive a work permit.

      3. No PERM Labor Certification Required

      • O-1 Visa: Direct petition without needing a labor market test.
      • EB-1A: Also doesn’t require PERM, but EB-1B (Outstanding Professors and Researchers) may require employer sponsorship.

      • O-1 Visa: Technically, it’s a non-immigrant visa, but it allows for dual intent, meaning you can apply for a green card while on O-1.
      • EB-1 Green Card: Purely immigrant-based.
